Authorities say that after the two men confronted each other, Spencer shot and killed Fosler. The Lonoke County Sheriff’s Office arrested Spencer on a preliminary charge of first-degree murder, which is a Class Y felony. Spencer was booked into the Lonoke County Detention Center but was released the next day after posting bail.
Lonoke County Sheriff John Staley made a statement, saying that Spencer has not been officially charged yet. The District Attorney’s Office will decide whether formal charges should be filed. Sheriff Staley expressed that this is a tragic situation and sent his thoughts and prayers to everyone involved.
Spencer’s wife, Heather, took to social media to explain their side of the story. She stated that Fosler had been ordered to have no contact with their daughter after he was accused of stalking and raping the girl over the summer. Heather also mentioned that she and her husband did not know that Fosler was in contact with their daughter again.
Heather expressed anger at how the sheriff’s office handled the situation, accusing them of protecting Fosler’s privacy more than the safety of their family. She thanked supporters for their messages and prayers but acknowledged that her family still has a long road to recovery.
Michael Fosler had been arrested earlier in the year for crimes like internet stalking and sexual assault. Investigators are continuing to gather information about the events leading up to the shooting to determine if the shooting was justified.
