(DailyAnswer.org) – A federal judge has dismissed the classified documents case against former President Donald Trump in Florida after she concluded that Special Counsel Jack Smith was appointed in an unlawful or unconstitutional manner.
Judge Aileen Cannon ruled in favor of a defense motion against the prosecution after finding that Smith, who was neither a US Attorney when appointed nor confirmed by the US Senate, could not legally bring the indictment against the former president.
President Joe Biden has been repeatedly accused by Trump and other Republicans of weaponizing the justice system ahead of the 2024 presidential election. In November 2022, the incumbent president was filmed saying that the Democrats would use “legitimate efforts” under the Constitution to make sure Trump cannot be reelected. Conservatives were accused of taking these words out of context to claim that Biden was unveiling plans to use lawfare to sabotage Trump’s election chances.
In May 2024, it was revealed that the arrangement of evidence seized by the FBI from Trump’s Mar-a-Lago resort in August 2022 had changed order. Donald Trump Jr accused Smith of tampering with the evidence, and following the findings the trial date was postponed indefinitely to ensure the integrity of the legal proceedings.
Biden stated that he was not surprised by Cannon’s ruling, and suggested that the verdict was motivated by Supreme Court Justice Clarence Thomas’ decision earlier in July to grant Trump absolute immunity. Biden inaccurately referred to Thomas’ concurring view as a dissent. Thomas has himself come under scrutiny over alleged bias and undisclosed gifts from wealthy conservatives. Democrats are currently fighting to expand the number of justices on what they consider an “illegitimate” and “broken” Supreme Court with a right-wing bias.
Cannon wrote that it seemed the Executive had grown increasingly comfortable with appointing special councils in “regulatory” roles in recent years with little in the way of judicial scrutiny. She added that the Court had endeavored to comply with the Constitution in its decision to dismiss Smith’s prosecution.
