Judge Merchan Could Sentence Trump To 30 Days In Jail

(DailyAnswer.org) – New York Supreme Court Justice Juan Merchan could give former President Donald Trump a 30-day  jail sentence after he allegedly violated a gag order branded “unconstitutional” by the 2024 Republican presidential candidate.

As Merchan is set to hold a hearing to determine whether the gag order was violated, prosecutors argue that the former president breached it 10 times. The order bars Trump from commenting publicly on witnesses taking part in the trial and also covers prospective jurors. In April, Trump claimed he had become a “modern-day Nelson Mandela” by speaking the truth about the judge, prompting criticism from the Mandela Foundation and several Democrats.

Though chances of a former president or president-elect ending up in jail may seem unlikely, the allegations that the former president violated the gag order multiple times could land him with a fine or even a prison sentence for contempt of court. Trump ally Mike Davis warned that it should come as no surprise if the former president is handed a jail term over the alleged gag order violations.

Davis serves as the president of the Article III Project, a conservative group. When asked in an interview if he thought Trump would end up behind bars as a result of the allegations, he replied “yes” and said that he could see Merchan and Manhattan District Attorney Alvin Bragg making it happen. Trump commented to reporters that people are allowed to talk about him despite him having a gag order, claiming this was “unfair.” He argued that his constitutional right to speak had been taken away. He said his political opponents persist in making up lies and called them “real scum.”

Regarding claims the former president made “willful violations” of the gag order, Trump’s lawyer Emil Bove argued that his comments were in response to those made by Michael Cohen about Trump. Bragg has charged the former president with 34 felonies in the criminal trial relating to allegations of election interference and a legal retainer payment received by Cohen. The trial is the first-ever criminal trial of a U.S. president. Polls indicate that only a third of adults in the U.S. believe Trump committed a crime.
